This study seeks to focus on one of the most significant family and social issues that have been suffered by Maghreb Region society, it is the issue of children custody after the parents' separation and the termination of marital link, which has thrown its weight on Maghreb Region terms of standards Code, in particular the terms of standards by Al-Wansharisi in order to avoid physical and moral harm which may affects the children as parents' separation, there is no doubt that the large number of marital disputes between both the man and his wife with persistence of such disputes have marked the life of Maghreb Region family with many difficulties and disputes, it sometimes led to confusion in the relationship between them, as well as confusion in their family and social milieu; as all the problems and disagreements that affect the husband and wife are a situation that may guarantee the collapse of the entire family’s status. at the time when the situation reaches the point of divorce or the wife’s separation from husband, as it is accepted that the marital relationship does not end once divorce is declared, but rather it remains there; a kind of link and relation between man and woman in many respects, one of the most important of these links is spousal alimony, and these links and relations are confirmed in the event of having children by spouses, followed by issues of child custody and the related requirements of breastfeeding and the children’s expenses of alimony; all of such matters deserve our attention and require verification, due to the fact that children custody stage is an essential period, and a very important time in a child's life due to the negative effects that may result on children in the future.
